1. Introduction
Greetings from CentralKnowledgePortal ("we," "us," or "our"). Your use of our website and yacht chartering services, available at centralknowledgeportal.site, (the "Service") managed by CentralKnowledgePortal, is ruled by these Terms & Conditions ("Terms").
By making a reservation for a charter or by using our Service, you consent to adhere to these Terms. You must refrain from using the Service if you do not agree with any section of these terms.
2. Service Overview
At CentralKnowledgePortal, we offer luxury yacht charter services, which include, amongst others:
- Yacht rentals on a daily basis
- Evening boat trips at sunset
- Business getaways
- Exclusive events
- Yacht charters spanning several days
Our services are provided based on their availability and are dependent on climatic conditions. We maintain the right to alter or cease any service without prior notice.
3. Booking and Reservations
3.1 Booking Process
In order to reserve a charter, you are required to:
- Be a minimum of 18 years old
- Supply truthful and complete details
- Remit the necessary deposit as indicated in your reservation confirmation
- Consent to these Terms & Conditions
3.2 Confirmation
A reservation is only considered confirmed after payment has been made and you have received our formal written confirmation. We maintain the discretion to decline services to any individual if deemed necessary.
3.3 Availability
Availability for charters is contingent upon both the availability of the vessel and favorable weather conditions. Every reasonable effort shall be made to accommodate your chosen dates and timings.
4. Terms of Payment
4.1 Cost Details
All quoted costs are presented in € and are inclusive of taxes where applicable, except as indicated. The prices are subject to modification without prior notice.
4.2 Schedule of Payments
- Initial Payment: 50% of the total cost of the charter is required at the time of reservation
- Remaining Amount: Payable 48 hours before the scheduled departure of the charter
- Supplemental Fees (if applicable): Payable at the end of the charter service
4.3 Modes of Payment
Payments can be made through major credit cards, wire transfers, and bank-certified cheques. All transactions are processed using secure and encrypted methods.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- If you cancel more than 72 hours before the scheduled departure, you will receive a full refund with the exception of any processing charges.
- Cancellations made between 24 to 72 hours before the departure are entitled to a 50% refund.
- Cancelling less than 24 hours prior to departure time will not be eligible for a refund.
5.2 Weather Cancellations
In case the captain determines weather conditions to be unsafe, we offer to:
- Move your booking to the next open date without any extra charges.
- Issue a full refund when rescheduling is unfeasible.
5.3 Mechanical Issues
Should your assigned boat encounter mechanical difficulties, we will strive to arrange a comparable alternative. If an alternative cannot be provided, you'll receive a complete refund.
6. Safety and Conduct
6.1 Safety Requirements
Every passenger is required to:
- Adhere to all instructions given by the crew
- Utilize the safety gear provided when necessary
- Inform the crew of any health conditions that could impact their well-being
- Stay within the assigned areas on the boat
6.2 Prohibited Items
The following are not allowed onboard:
- Bottles made of glass
- Controlled substances that are illegal
- Weapons or any form of firearm
- Excessive amounts of alcohol (more than what is deemed reasonable for consumption)
- Animals (with exceptions for those that have received prior authorization)
6.3 Conduct
Passengers are expected to behave respectfully. Should a passenger's actions create a safety hazard or interfere with the enjoyment of others, we maintain the right to end the charter before the scheduled time without issuing a refund.
7. Liability and Insurance
7.1 Our Liability
Our financial responsibility is confined to the cost incurred for your charter. For the following, we are not accountable:
- Injuries to oneself due to personal carelessness
- Loss or damage to individual belongings
- Secondary, incidental, or penal damages
- Delays due to weather or other factors not within our influence
7.2 Insurance Coverage
We hold extensive maritime insurance for our boats and operational activities. Guests must ensure they have their own travel and personal insurance.
7.3 Assumption of Risk
By engaging in our charter offerings, you accept that undertaking marine operations comes with unavoidable risks, and you take the duty for securing your safety and health.
8. Modifications and Itinerary Changes
The company retains the discretion to alter travel plans, paths, or timetables due to elements like weather patterns, safety concerns, or essential operations. All feasible alternatives of similar value will be pursued.
9. Force Majeure
The company shall bear no responsibility for hold-ups, termination, or variations that happen as a consequence of factors not under our influence, including but not limited to:
- Extreme weather conditions
- Catastrophes of nature
- Official decrees
- Termination of port operations
- Breakdowns of machinery
10. Privacy and Data Protection
We manage your personal data in compliance with our Privacy Policy. Your use of our services implies agreement to our data collection and usage as outlined in the Privacy Policy.
11. Intellectual Property
The proprietary material on our site, such as texts, visuals, symbols, and illustrations, is safeguarded by copyright and trademark regulations. Without express authorization in writing from us, you are not allowed to copy, circulate, or adapt any work derived from this content.
12. Governing Law
